The Iowa Attorney General’s Office has declared that an officer-involved shooting in Storm Lake in late January was justified.
The incident began shortly before 8am on Sunday, January 26th when a Buena Vista County Sheriff’s deputy attempted to pull over 45-year-old Daniel Palenik for drifting between lanes. Palenik drove away at speeds up to 115 miles-per-hour. Deputies pursued Palenik to his residence at 325 Oneida Street in Storm Lake. Palenik reportedly doused the residence with gasoline and barricaded himself inside for 19 hours. He fired approximately 120 rounds at officers throughout the standoff. Palenik was eventually shot to death around 2:30am the following morning on January 27th.
The Iowa AG’s Office concludes that the officers’ actions were legally justified, and considers the investigation closed.
Storm Lake Police Chief Chris Cole states…
“We fully support this decision and stand by the brave men and women who put themselves in harm’s way to protect our community. We’re grateful for the response of our officers and the assisting agencies who came to our aid during this intense 19-hour standoff. Their quick response, professionalism, and discipline under fire were nothing short of extraordinary. Despite facing an extremely volatile situation, where over 120 rounds were fired at police from an AK-47 and other firearms, the responding officers remained steadfast in their duty to protect and serve. We’re thankful that no officers or civilians were injured during this event. This incident serves as a reminder of the dangers faced and the sacrifices made by those who wear the badge. We’re incredibly proud of each and every one of them. We appreciate the continued support from our community and remain committed to serving and protecting all who call the City of Storm Lake home.
