A judge has ruled against the owner of a Spencer trailer court who sued after the city turned off power to the trailer court just east of the Clay County Fairgrounds.
The City of Spencer took the action last month citing safety concerns over wiring and other issues. Owner Bill Caskey was seeking an injunction to get power restored to the trailer court. But, District Court Judge Shayne Mayer sites an administrative rule prohibiting dangerous conditions from existing in residential areas. The judge adds that claims by those who are still living at the trailer court about what they say are dangerous conditions due to there being no power don’t hold merit because those residents are still choosing to live there.
