A county attorney has filed a motion to dismiss an attempted murder charge involving a Northwest Iowa teenager.
According to a press release, on Friday, June 20, the Sac County attorney filed a motion to dismiss one count of Attempt to Commit Murder in the case of 16-year-old Keegan Kennedy, due to a lack of evidence.
Court documents show on Thursday, June 12, the court ordered Kennedy to be released from the Sac County Jail to the custody of his parents. He was reportedly released on multiple conditions, which include house arrest and GPS monitoring.
Kennedy previously pleaded not guilty and demanded a speedy trial; however, as a condition of his release, he waived his right to a speedy trial on Tuesday, June 10. On Wednesday, May 21, the defense attorney for Kennedy previously requested his trial to be transferred to juvenile court, due to his mental health issues.
The charges date back to a shooting that took place near Black Hawk in Sac County, Iowa, on Sunday, May 4. During the incident, Kennedy shot another person in the face during an argument, according to documents.
The argument reportedly took place between 5:30 a.m. and 6:30 a.m. Kennedy was arrested and later charged on Wednesday, May 7.
A jury trial is scheduled for Tuesday, July 22.
