A Shenandoah man accused of killing a Manning woman in an August shooting in Lake View will remain jailed on a $1 million cash-only bond following a court hearing Monday in Sac County District Court.
Twenty-seven-year-old Joshua Lehman is charged with first-degree murder in the death of 27-year-old Dr. Rylie-Shea Muhlbauer.
Lehman appeared before Judge Angela Doyle Monday afternoon for a hearing on his pretrial detention and bond.
According to court records, Lehman’s defense asked the court to set bond and declare part of a recently enacted Iowa law unconstitutional.
Senate File 2218 took effect this year and includes new provisions governing pretrial detention. Under Section 34, defendants charged with a forcible felony are presumed to pose a danger and that conditions of release would not adequately protect others. If probable cause is found, the law allows a court to order detention without bail unless the defendant rebuts that presumption.
First-degree murder is classified as a forcible felony under Iowa law.
The state filed a motion seeking pretrial detention and opposed Lehman’s request for bond and his constitutional challenge to the law.
Judge Doyle ultimately kept Lehman’s bond at $1 million, cash only, and rejected the defense argument that a cash-only bond violates Iowa’s constitutional guarantee of bail.
The state also filed a memorandum supporting pretrial detention, along with attachments. Those records have been restricted from public access by court order.
Lehman entered a formal written plea of not guilty Aug. 31 and waived his right to a speedy trial.
The Iowa Division of Criminal Investigation says a 911 call was received shortly after 10:27 a.m. Aug. 2 reporting a shooting at a residence on East Shore Drive in Lake View. Responding officers found Muhlbauer deceased, and Lehman was arrested later that day.
Lehman remains held in the Sac County Jail.
