New Trial Motion Denied

The man found guilty of the murder of Algona Police Officer Kevin Cram has been denied his motion for a new trial. On August 5th, 44-year-old Kyle Ricke’s attorney had filed for a new trial. The main reason, according to his attorney, was the events that transpired over 90 seconds do not prove premeditation. Ricke’s attorney says the court shouldn’t have overruled a motion for acquittal because there wasn’t sufficient evidence to prove beyond a reasonable doubt that Ricke acted with “malice aforethought” and premeditation. Ricke’s attorney insists her client showed no prior animosity or desire to harm Officer Kevin Cram. And, the attorney says 90 seconds passed from the time Ricke left Officer Cram’s presence to the time the fatal shots were fired. Ricke’s attorney says that wasn’t enough time for Ricke to form that premeditation. Prosecutors in the case say the fact that Ricke used a “dangerous weapon” shows his premeditation.
